Terms and Conditions

1. GENERAL

These General Terms and Conditions ("Ts & Cs" or "Agreement") constitute and govern the contractual relationship between the parties herein, namely: KGL Technology LTD a private company limited by shares incorporated under the laws of Republic of Ghana with registration number CS053202020 (which expression shall where the context so requires, includes its representatives and assigns) and "You", as the user and customer of NLA 5/90 Online Lottery (USSD, Web and Mobile Applications).

2. DEFINITIONS AND INTERPRETATIONS

In these Ts & Cs, the following words and expressions shall have the meaning set forth herein:

"Debited Amount" shall mean the amount deducted from the Player's mobile money wallet and or account to play the Game as initiated by the Player.

"Game" shall mean the NLA 5/90 Online Lottery played either through USSD, Web and Mobile Applications'

"KGL", "We", "Us", or "Our" shall mean KGL Technology LTD, the authorised licensed operator of NLA 5/90 Online Lottery (USSD, Web and Mobile Applications) and an Online Lotto Marketing Company;

"National Lottery Authority" or "NLA" means the regulatory body in Ghana responsible for organizing raffles and lotteries in Ghana, in accordance with the National Lottery Authority Act, 2006 (Act 722) and the Lottery Regulations 2008 (L.I. 1948);

"Player", "You" or "Yours" means any individual (18years or above) or entity that expressly or impliedly agrees to all these General Terms and Conditions when dialing *959# or accessing www.590mobile.com.gh or via any other digital medium to play NLA 5/90 game.

"Stake" or "Amount Staked" shall mean the Debited Amount, less any allowable deductions. The Stake shall be deemed valid when there is a deduction or debit from a Player's corresponding account for any Game(s) played.

"E-Ticket" shall mean the SMS containing the game type, numbers played, value of the stake, date of the draw and unique ticket number generated by the 5/90 Mobile platform.

3. SCOPE

These Ts & Cs outlines the responsibilities of KGL and NLA in respect of the gameplay channels; bears and covers the governing rules for Players, user requirements, applicable user rights, user responsibilities and gameplay restrictions associated with the Game.

By accessing the Game and/or playing the Game, the Player acknowledges to have read and understood the governing rules of the Game and accepts to be bound by these Ts & Cs of the Game.

4. GAME DETAILS

a. The winning multipliers for the various Games will be as follows:

b. The examples below clarify further the table above:

i. For a Debited Amount of GHS1.00 from a Player's wallet/account: The Player shall win GHS 40.00 for "Direct 1", GHS240.00 for "Direct 2 (2Sure)", GHS2100 for Direct 3, GHS6,000.00 for Direct 4, GHS44,000.00 for Direct 5, GHS240.00 for Perm 2, GHS2100.00 for Perm 3 and GHS 960.00 for Banker.

c. There are two types of Games held from Monday to Saturday namely; "Noon Rush" and "Original 5/90". Sundays has only the Original 5/90.

i. NOON-RUSH
Noon Rush is held from Monday to Saturday. These are termed Monday Noon Rush, Tuesday Noon Rush, Wednesday Noon Rush, Thursday Noon Rush, Friday Noon Rush and Saturday Noon Rush. Each Game opens from 8:30 PM on the relevant day to 1:25 PM the following day, except Monday Noon Rush which opens at 6:30 PM of the previous day. This Game allows Players to select at least one out of ninety balls numbered 1 – 90 to stake any of the variations stated under subclause 4(e). Five (5) out of the ninety (90) balls are randomly selected by the NLA during a draw. The draw is held at 1:30 PM each gameday of the week, excluding Sundays and statutory holidays, unless otherwise specified, communicated or determined by the NLA. If the numbers on the five (5) selected balls match any of the numbers selected by the Player at the time of play, the Player would be declared a winner, depending on the variation of the Game played, as stated under subclause 4(e) below.

ii. ORIGINAL-5/90
The Original 590 Games are also held each day of the week. These are termed Monday Special, Lucky Tuesday, Midweek, Fortune Thursday, Friday Bonanza, National Weekly and Sunday Aseda. Each Game opens from 1:30 PM to 7:55 PM every day except for Sunday Aseda, which opens from 8:30 PM Saturday evening to 5:55 PM on Sunday. This Game allows Players to select at least one out of ninety balls numbered 1 - 90 to stake any of the variations stated under subclause 4(e). Five (5) out of the ninety (90) balls are randomly selected by the NLA during a draw. The draw is held at 8:00 PM each game day of the week, excluding statutory holidays and Sundays, unless otherwise specified, communicated or determined by the NLA. Draws for Sunday Aseda are held at 6:00pm on the said day. If the numbers on the 5 selected balls match any of the numbers selected by the Player at the time of play, the player would be declared a winner, depending on the variation of the Game played, as stated under subclause 4(e) below.

d. The variations of games that can be played each day are as provided below:

i. Direct-1: - The first number drawn is called the 1st Winning Number. (For example, if a Player selects number 45, he wins if 45 it is the first number drawn);

ii. Direct 2: - Any two (2) numbers out of the five (5) winning numbers to be drawn. (For example, if a Player selects 37 and 17, he's a winner if 37 and 17 are among the five (5) numbers drawn);

iii. Direct 3: - Any three (3) numbers out of the five (5) winning numbers to be drawn. (For example, if a player selects 21, 48 and 83, he's a winner if 21, 48 and 83 are among the five (5) numbers drawn);

iv. Direct 4:- Any four (4) numbers out of the five (5) winning numbers to be drawn. (For example, if a player selects 21, 48, 83 and 45, he's a winner if they are among the five (5) numbers drawn.);

v. Direct 5: - All five (5) numbers chosen must be winning numbers. (For example, if a Player selects any five (5) numbers from 1 to 90, and all five (5) numbers are drawn, then he is a winner;

vi. Perm-2: - This is basically selecting more than two (2) numbers and combining them in sets of two (2). If a Player selects numbers 10-20-30, Perm2 will give combinations of (i) 10-20, (ii) 10-30 and (iii) 20-30. Here, the winning pattern is the same as Direct-2;

vii. Perm 3: -This is basically selecting more than three (3) numbers and combining them in sets of three (3). If a Player selects numbers 10-20-30-40, Perm3 will give combinations of (i) 10-20-30, (ii) 10-20-40, (iii) 10-30-40 (iv) 20-30-40. Here, the winning pattern is the same as direct-3;

viii. Banker 1 against all: - This is selecting one (1) number and pairing it with the rest of eighty-nine (89) numbers. (that is, any number selected becomes the Banker number to be paired against the 89 remaining numbers). This banker must be one of the five (5) winning numbers in the draw.

e. Players of the Game must ensure that a specific variation of the Game is selected and played before the Game closes and the draw for that Game is held. Any Game played after the closing time or after a draw for that Game commences shall be invalid and ineligible for any winnings.

f. E-tickets shall be generated for every Game and sent to a player except in instances where a player does not receive an e-ticket due to technical challenges.

5. REVISIONS TO TERMS AND CONDITIONS

a. KGL and/or NLA reserves the right to effect changes to these Ts & Cs and the gameplay mechanics at any time it deems fit and without prior notice to the Players. Update to the Ts & Cs will be reflected via in-game play (USSD *959#, Web and Mobile Applications) or respective online channels website and/or social media handles of regulator (NLA) and/or digital service provider (KGL).

b. KGL shall use its best endeavors to communicate any changes to these Ts & Cs to the Players. By continuing to stake the Game, the Player agrees to be bound by the Ts & Cs as well as future modifications to it. A Player shall not use or access the Game platform (s) and/ or place a stake of the Game where the Player does not agree to these Ts & Cs or any further modifications thereof.

6. COPYRIGHT

All Game contents contained in either gameplay, communication materials, related software or hosted on third-party platforms, is and remains the property of KGL and/ or NLA and their respective affiliates or strategic partners and are subject to the copyright laws of Ghana. None of the content may be reproduced, published, transmitted, distributed, displayed, modified or exploited in any way, in whole or in part without the prior written consent of KGL and/or NLA.

7. TRADEMARKS

The name "5/90 Mobile", and all associated lottery game names and references, as well as the technical platform, related software and all other graphics and logos displayed across all communication channels/platforms remain the sole property of NLA or have been licensed for use by the NLA and without the express prior written permission of the NLA, may not be used at any time in any form (including but not limited to advertising, as an endorsement for any product or service, or any other purpose, commercial or otherwise).

8. LINKS

a. KGL and/or NLA may, from time to time, provide referral links or drive awareness for prospective Players to access the USSD short code *959# to play the 5/90 Mobile Game or to access the Game via other gameplay channels. KGL and the NLA is not responsible for the activities of other unauthorized links or any communication material content not sanctioned by the KGL and/NLA and its affiliates.

b. KGL and/or NLA, and their affiliates provide these links only as additional resources for its Players and make no representations regarding the content of any linked web site, short code (except *959#) or any companies that own, control or manage these channels. Consequently, KGL and/or NLA, and their affiliates will not be, in any way or form, responsible for the accuracy, relevance, copyright compliance, legal conditions or decency of material contained in, programs used by, or services or products offered by, external channels not sanctioned by the KGL and/or NLA, and their affiliates.

9. SMS / ADVERTISEMENTS

a. KGL, on behalf of the NLA, shall provide SMS based messaging services to notify users of all transactions performed on the NLA USSD based 5/90 Mobile via *959#.

b. Promotional activities via SMS (text messages), traditional media (TV, Radio, Billboard, Online, Social Media among others), below the line activations and other advertising channels will be employed to promote the daily Games.

c. KGL may also provide the Player, via SMS, with a link through which all revisions to these Terms and Conditions may be accessed.

d. The Player by playing the Game acknowledges and accepts to receive all communication and promotional content governing the gameplay.

e. By accessing the Game via USSD, the Player agrees to receive these SMS and advertisement materials from KGL.

10. FEEDBACK

a. Any comments or materials sent or transmitted, including but not limited to, electronic mail, standard mail, social media post, phone calls, SMS (text messages) or other communication channel regarding any content or information found in respect of the Game, including, without limitation, data, questions, comments or suggestions (collectively referred to as "Feedback"), which will not be treated as confidential, shall become the property of KGL and may be subject to disclosure under applicable laws.

b. We do not have an obligation of any kind with respect to Feedback and will be free to reproduce, use, disclose, exhibit, display, transform, distribute, and create derivative works from Feedback.

11. SECURITY OF NLA 5/90 MOBILE GAME USSD

a. Kindly be advised that the security of the USSD gaming portal hosted by KGL on behalf of the regulator (NLA) and its affiliates including telecommunications networks is secure and all mobile transactions and player data is encrypted ensuring gameplay security.

b. However, please also be advised that KGL, NLA and their associates cannot accept and are not responsible for any unauthorized access to your phone that results in gameplay on the NLA 5/90 Mobile Game via USSD *959# short code and mobile money transactions.

c. KGL shall take steps to preserve the privacy of personal information and gameplay security. Kindly review the NLA 590Mobile Privacy Policy for more information about how KGL handles personal information.

12. ELIGIBILITY

a. The Game is restricted to Players of ages eighteen (18) and above, has a phone number registered in the Republic of Ghana and owning mobile money accounts linked to the same number used in playing the Game across any of the local mobile networks (MTN, Telecel, AT).

b. Dialing *959# to purchase a ticket/stake and playing the Game on any device indicates Your understanding of all the rules and regulations of the Game and Your consent to be bound by these Ts & Cs. We reserve full rights to change any terms and conditions without prior notice and Players will abide by the same.

13. INDEMNITY

Players shall indemnify and hold harmless KGL, its affiliates, strategic partners (and their respective directors, officers, agents, Games Service Providers and employees) from and against any and all losses arising out of, relating to or in connection with the Game, except to the extent any such loss arises from KGL's intentional breach, fraud, gross negligence or willful misconduct.

14. LIMITATION OF LIABILITY

a. To the fullest extent permitted by law, KGL, its affiliates, partners, agents, and service providers shall not be liable to any Player for any direct, indirect, incidental, special, or consequential loss or damage, including but not limited to loss of winnings, data, profits, goodwill, or business opportunities, arising from or in connection with the use of the NLA 5/90 Mobile Game or any related service.

b. Without limiting the generality of the foregoing, KGL shall not be liable to any Player for:

i. Games played outside the scope of time expressly stated under subclause 4(d), whether due to technical challenges, transmission errors and/or delays, or the misuse or manipulation of data;
ii. Downtime, server disruptions, system or communication failures, or any other technological malfunctions that may affect gameplay or result in the loss of data or inability to complete a transaction;
iii. Any gameplay activity resulting from unauthorized access to a Player's mobile device or mobile money account;
iv. Any delay or failure in fulfilling its obligations under these Terms and Conditions caused by Force Majeure events (as defined under the Force Majeure clause);
v. Any winnings made on Stakes above the maximum limit;
vi. Any damages resulting from any acts or omissions of third parties, including payment service providers, mobile network operators, or unauthorized third-party links.

c. In any event, KGL's total liability to a Player, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount staked by the Player in the affected Game(s), provided such amount can be reasonably verified.

15. DRAW RESULTS

The Game draws shall be in accordance with Regulation 21 of the Lottery Regulations 2008 (L.I. 1948).

16. THIRD-PARTY CHARGES & OMISSIONS

a. Transaction Charges –– Players shall bear the cost of any transaction fees they may incur when depositing or withdrawing from their mobile money wallets while playing the Game.

b. Third Party Omissions – KGL is not liable for transmission errors, and the Player shall have no claims for compensation due to any transmission errors, delays, or the misuse or manipulation of data.

17. GOVERNING LAW AND DISPUTE RESOLUTION

a. These Ts & Cs shall be governed by and interpreted in accordance with the laws of the Republic of Ghana.

b. Any dispute, controversy, claim, or difference arising out of, or in connection with, or resulting from these Ts & Cs in respect of its application or interpretation, or a breach thereof, which cannot be settled amicably by the parties within thirty (30) days of its occurrence, shall be resolved, for all purposes in connection with this Agreement, by a Court of competent jurisdiction in the Republic of Ghana.

18. FORCE MAJEURE

KGL shall not be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes (which causes are hereinafter referred to as "Force Majeure"), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemics, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or generalized lack of availability of raw materials or energy.

19. ADDITIONAL TERMS AND CONDITIONS

a. Any indication of fraud, manipulation, cash-back arbitrage, or other forms of deceitful or fraudulent activity which is the basis of a pay out or otherwise on the part of the Player will render the Player's account inactive along with any and all profits or losses gathered.

b. Any suspicious or fraudulent transactions will be immediately reported to the relevant authorities.

c. KGL shall treat as highly confidential the information the Player entrusts to it, in accordance with its Privacy Policy.

d. The waiver by KGL of any of its rights or remedies or of any breach by the Player under these Ts & Cs in a particular instance shall not be considered as a waiver of any other or the same or different rights, remedies, or breaches in any other or subsequent instances.

e. By playing the Game the Player is acknowledging that he or she is at the risk of losing money. It is the Player's sole responsibility to assume any losses suffered as a result of staking this Game.

f. All transactions will be processed in accordance with Ghana's anti-money laundering regulations.

g. KGL reserves the right, in its sole discretion, to void any winnings, to refuse or cancel the services, and/or refuse to distribute profits to anyone for one or more of the following reasons:

i. The Player provides incorrect or misleading information on his/her mobile money account;
ii. The Player has neglected or has failed to provide the required identification documents;
iii. The Player provides documents which do not match with the data from mobile money account data;
iv. The Player uses or accesses the game from a jurisdiction in which the game is deemed to be illegal activity according to applicable law;
v. The Player uses money gained through criminal, unauthorized or other illegal activities to play the Game;
vi. The Player plays the Game after the Game closes or after the draw commences;
vii. The Player plays an amount above the maximum stake amount;
viii. The Player is not of legal age (below 18 years);
ix. The Player has defrauded or attempted to defraud KGL or any of its partners and affiliates. This includes defrauding through the use of software, techniques, computer, machines or similar tools, or the establishment of a syndicate of players in order to defraud or to cause damage to KGL, its Players or any other party;
x. The Player has allowed or permitted access to a third party to use his mobile money account to attempt to defraud or to cause damage to KGL, its Players or any other party.

h. For the purpose of the provisions under this sub clause 19, KGL shall make no exception for intentional and unintentional actions of the Player.

i. The list of reasonable grounds above is not exhaustive.

20. PAYMENTS

The Player expressly authorizes KGL to make payment of wins directly to mobile money account used by the Player to stake the Game and shall hold KGL harmless of any loss or problems arising out of payment of wins to this mobile money account used by the Player to stake the Game.

21. DURATION

The term of these Ts & Cs shall be for an indefinite period subject to future amendments and should the Player wish to terminate these Ts & Cs at any time, he/she may discontinue from staking the Game.

22. STAKE LIMITS

The stake limits are as follows:

a. The minimum stake or play per ticket is: One Ghana Cedi (GHS 1.00);
b. The maximum stake or play per ticket is: Two Hundred Ghana Cedis (GHS 200.00).

23. COMMITMENT TO DISCUSSIONS

In the event of any dispute in respect of the Game or the payment or award of any Game winnings, KGL may withhold payment of the Game winnings until any dispute has been fully resolved.

24. MISCARRIED AND ABORTED GAMES/STAKES

a. KGL shall take every precaution to avoid as much as possible, any technical anomaly or problem.

b. KGL, its suppliers and/or licensors shall not be liable for the following:

i. any downtime, server disruptions, lagging, or any technical or political disturbance to the gameplay. Refunds for any losses resulting from the foregoing shall be at the discretion of KGL;
ii. any damages or losses which are deemed or alleged to have arisen out of or in connection with Our website game play channel or its content, including and without limitation to:

• Delays or interruptions in operation or transmission;
• Loss or corruption of data;
• Communication or lines failure;
• Any site or content misuse;
• Any errors or omissions in content.

c. All valid stakes shall be refunded to Players where a lottery draw does not take place at NLA. If Your game miscarries because of a failure of the system, KGL shall refund the amount wagered in Your game at our discretion by crediting it to Your mobile money account or, if Your mobile money account no longer exists, by paying it to You directly, in an approved manner.

25. PRIVACY POLICY

Here at KGL Technology LTD ("KGL" or "we") we are strongly committed to ensuring that your personal data is well protected and your privacy is respected. This Privacy Policy explains how KGL collects, discloses, uses and safeguards your personal data when you play the NLA 5/90 Online Lottery (the "Game") on our USSD, Web and Mobile Application platforms.

By playing the Game via any of the available platforms, you consent to the collection, use and disclosure of your personal data in accordance with this Privacy Policy. We therefore encourage you to take a moment to read it carefully to better understand how we process and protect your personal data.

DATA CONTROLLER

The Data Controller of your personal data collected while you play the Game is KGL Technology LTD of KGL House, 134 Ndabaningi Sithole Road, Labone, Accra, Ghana.

THE DATA WE COLLECT

In order to effectively operate and provide access to the Game, we collect certain personal data from you. This data is mandatory as it is essential for the functionality and delivery of the Game. If you do not consent to the processing of your personal data, you will be unable to play the Game. In the interest of transparency, we collect the following personal information when you play the Game via USSD, Web and Mobile Applications platforms:

We collect information such as your name and telephone number when you are setting up an account with us to enable you play the Game via the Web.
We collect your telephone number when you play the Game via USSD.
We collect information on the stakes you place.

HOW WE USE THE DATA WE COLLECT

We are committed to ensuring that the personal data that we collect from you is processed lawfully and in accordance with the Data Protection Act, 2012 (Act 843) (the "Act") and any further amendments to the Act. By accessing and playing the Game, you are deemed to have given your consent to the collection and the use of your personal data for the following purposes:

The operation of the Game: we use the data we collect to deliver key functionalities on our various platforms and also to manage the accounts of the users of our platforms such as the Web and Mobile Application Platforms;
To process transactions: we use the data we collect such as your telephone number to issue you with a ticket ID and make payments of winnings;
Marketing and promotional purposes: we use the data we collect to inform you of unique promotional offerings or features via phone call or SMS. By agreeing to our terms and conditions, you consent to receiving such promotional information. You may however opt out of this by contacting our customer support helpline on 0308249477 or simply following the prompts in the promotional SMS sent to you;
To communicate with you: aside from promotional information, we use the data we collect to provide you with service-related updates such as changes to our terms and conditions and relevant changes to the Game;
Customer support and improvement of customer service delivery: we use the data we collect to respond to inquiries you may have. We also use the information we collect to enhance your customer support services to enable us resolve issues more efficiently. This means that we may record your calls when you contact our customer service helpline or collect feedback you provide us on any of our platforms.

DISCLOSURE OF YOUR DATA

We may disclose your personal data to third parties in accordance with this Privacy Policy and the Act. We may disclose your data in the following circumstances:

We may share your personal data with third-party service providers who we engage to perform certain functions on our behalf. These service providers are contractually bound to process data only as instructed by us and are not permitted to disclose your data or process your data in any way that is not authorised by us;
We may disclose your personal data to law enforcement agencies, regulatory bodies or other similar public authorities where the disclosure is relevant to satisfy applicable laws or legal processes such as subpoenas, or to prevent any illegal activity or to protect our legal rights or the safety of our customers, employees, agents or others;
We may share your personal data with affiliated companies, subsidiaries or our parent company for the purposes of business continuity, internal administrative processes and in the event where there is a joint collaborative effort to provide services to you;
In the event of mergers, acquisitions, reorganizations, sales of assets, we may transfer your data to the third party involved in the transaction and will take reasonable steps to ensure the continuous protection of your personal data;
In the event of where you win a significant amount of money from playing the Game, we may publish your first name and the first letter of your surname on our website and social media pages. We shall however only disclose your full name to the public if you give us your consent to do so;
In any other case, we shall only share or disclose your personal data when we receive your consent to do so.

HOW LONG DO WE RETAIN YOUR DATA

We shall retain the personal data we collect from you for as long as is necessary to achieve the purpose for which we collected the data or as required by law. At the end of our retention period, we shall delete, destroy or anonymize the record of your personal data.

SECURITY MEASURES

We adopt reasonable, appropriate, technical, organizational and physical safeguards to ensure that your personal data is safe and prevent unlawful access to your data. However, while we do this, we understand that no system can be one hundred percent secure and as such we cannot guarantee the absolute security of your data. In the event that we have reasonable grounds to believe that your data has been unlawfully accessed by an unauthorized person, we shall notify you of this in accordance with the Act.

YOUR RIGHTS

As a data subject, you are entitled to certain rights under the Act. We have outlined some of these rights below for your convenience:

Right to access your personal data: you have the right to request us to confirm whether we hold any personal data about you and give you a description of your personal data which we hold or the identity of a third party who has access to that data. We shall however charge you a small fee and verify your identity before we do so;
Right to correct your personal data: you have the right to request us to correct or delete your personal data which is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained. You can also ask us to destroy or delete a record of your personal data that we no longer have authorization to keep;
Right to prevent us from processing your personal data: you have the right to serve us with a notice in writing to stop processing your personal data where such processing is causing or is likely to cause unwarranted damage or distress. Once we receive your request, we shall strive to respond to you within twenty-one (21) business days to confirm whether we have complied with your request or we intend to comply with your request or in the event where we are unable to comply with your request, our reason for non-compliance.

PRIVACY OF CHILDREN

The Game is intended for individuals aged eighteen (18) years and above. We do not knowingly collect and process the data of persons below the age of eighteen (18). If you are a parent or legal guardian of a person under the age of eighteen (18) who has provided us with personal data, you may contact us in writing to request that we cease processing and delete any such data from our records.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to update this Privacy Policy from time to time to reflect changes in our operations or legal requirements. Where we update this Privacy Policy, we will provide notice of this on our website or in some cases send you a direct notification. By continuing to play the Game after being notified of any update to this Privacy Policy, you are deemed to have accepted and consented to the revised terms.

26. COMPLAINTS

a. All complaints or issues associated with playing the Game should be addressed to Our customer service support by dialing 0308249477 and detailing the nature of the complaint or issue.

b. Our customer service representatives shall address and resolve complaints instantly or escalate to appropriate units or parties for it to be resolved. We shall use Our best endeavours to resolve customer complaints within reasonable timelines.

27. SEVERABILITY CLAUSE

Each clause contained in these Ts & Cs shall be separate and severable from each of the others. If any clause is found to be void, invalid, or unenforceable for any reason whatsoever, the remaining clauses shall remain in full force and effect.

28. DECLARATION BY PLAYERS

a. I am 18 years old or older. I am physically present in the Republic of Ghana or any other country in which the NLA has authorised the operation of the Game while playing the Game. By continuing to play this game, I acknowledge that I have read and understood all the rules and regulations of the Game and I agree to be bound by these Ts & Cs.

b. I acknowledge that KGL and/or the NLA has the full rights to change any term or condition without prior notice to me. I also understand that KGL shall use its best endeavors to communicate any changes to these Ts & Cs to the Players. By continuing to stake the Game, I agree to be bound by the Ts & Cs as well as well as any future modifications to it.

c. I understand that a Player shall not use or access the Game platform (s) and/ or place a stake of the Game where the Player does not agree these Ts & Cs or any further modifications thereof.

d. I understand that the Game is available to, and may only be used by individuals, who can enter into legally binding contracts under the laws of the Republic of Ghana or any other country in which the NLA has authorised the operation of the Game. I certify that I qualify and meet these requirements. In all circumstances, KGL shall not be held responsible for misuse of the services by any unauthorized parties or minors.

e. I understand that KGL may amend and/or assign its obligations and rights under these Ts & Cs to from time to time, and I shall be bound by it.

29. ACCESSIBILITY

For ease of access to these Ts & Cs, the Players may print these Ts & Cs and any modifications thereof for their records.
